There are a number of Benewah County Sheriff’s office police that in my opinion do not align State Law or the Constitution’s. Below are a few of the policies that should be reviewed for legality and constitutionality.
Recording Policy
Benewah County Sheriffs Office

Idaho State Law
One party may record the conversation.

Issue: If you can’t record the sheriff without out his permission, you have no way document issues with the sheriff. Without documentation you have no way to hold them accountable for what they say.
Disloyalty Policy
Benewah County Sheriffs Office

Issue: The deputies loyalty should be to the Federal and State constitution’s and protection of individual’s rights. Deputies swear an oath to the constitution, not the office.
Rules Policy

Issue: Rules created by a department, supervisor and or an appointed official may not always be legal or constitutional. There should be at minimum a clause in here that says “lawful and constitutional rules” and all personnel needs to be trained on constitutional principle’s.
